FREEDOM OF INFORMATION

Purpose

The Construction Industry Authority of the Philippines’ (CIAP) Freedom of Information (FOI) Manual shall serve as the guidebook of the public in exercising their constitutional right to information on matters of public concern, pursuant to Executive Order (EO) No. 2 (s. 2016). It shall cover all requests for information directed to CIAP and its Implementing Boards (PCAB, POCB, PDCB, CMDF, and CIAC).

 

Policy Statement  

In line with the constitutional mandate upholding the right to freedom of information and implementation of full public disclosure of all its transactions involving public interest, CIAP is committed to release information to the public involving public interest, subject to limitations as provided by the Constitution, applicable laws, rules, regulations and procedures, such as Republic Act (RA) No. 10173, otherwise known as the “Data Privacy Act,” and the List of Exceptions approved by the Office of the President, among others.

 

Procedure for Filing FOI Request: 

  Through Standard Paper-based Request Form 

  1. Requesting party should fill out and submit the FOI Request Form to the CIAP Office. 
  2. If the request is found to be compliant with the requirements under the manual, the CIAP FRO has to stamp the form, including the date and time of request.
  3. A response is expected within fifteen (15) working days following date of receipt of the request. Working days are those other than Saturday, Sunday, or a day declared a national holiday in the Philippines.
  4. If the requested information requires further details to identify or locate, the fifteen (15) working days start the day after it gets the required clarification from the requesting party. In such cases, the requesting party shall be informed by the CIAP.

 

Through the eFOI Platform (www.foi.gov.ph): 

  1.  Click the Log-in button and enter the email address and password. 
  2. In case the requestor is a new user, click the Sign-up button, and provide the required information.
  3. Once logged-in, the user will be directed to the Dashboard. The Dashboard contains all the requests done by the account owner.
  4. Click the “Make a Request” button. Once clicked, the user may choose the name of the agency.
  5. Users will be directed to the Make a Request Page. Complete the required fields. Once sent, the request will be forwarded to the Receiving Officer of the concerned agency.
  6. The same process of clarification, retrieval, and approval of release applies to the eFOI platform.
  7. Once approved, the response will be posted to the user’s Dashboard. 

 

 

FOI Receiving Officer 

The Construction Industry Authority of the Philippines (CIAP) have their respective FOI Receiving Officers (FROs) and FOI Decision Makers (FDMs). 

The agency FOI Receiving Officer (FRO) is the Policy and Program Coordination and Monitoring Division, with the following contact information:

The FRO performs the following duties: 

    • Receive on behalf of CIAP all requests for information and facilitate such request;  
    • Ensure that the FOI request form is completely accomplished; 
    • Provide assistance and support with regard to FOI;  
    • Process all requests and forward to the concerned office (within and outside CIAP) as may be appropriate;  
    • Provide assistance in ensuring all requests are responded to within the prescribed time;  
    • Monitor all FOI requests and appeals; 
    • Provide assistance to the FOI Decision Maker;  
    • Compile statistical information as required; and  
    • Conduct initial assessment of the request and advise the requesting party whether the request will be forwarded to the FOI Decision Maker for further evaluation. 

Requests may be made through the following:

    • Bring the filled-out FOI Request Form the CIAP office; 
    • Download the FOI Request Form fill out and send to ciap@construction.gov.ph.;  
    • Persons with disabilities (PWD) or illiteracy may make an oral request to the concerned FRO, which the FRO will put into writing, for signing by the concerned party; or 
    • Create an eFOI account and submit your request through the eFOI Platform (www.foi.gov.ph) 

 

Fees and Costs 

There are no fees to make a request, but the CIAP may charge a reasonable fee for necessary costs, including costs of printing, reproduction and/or photocopying.
